Know Your Rights

The following rights apply to all women, regardless of immigration status, race, ethnicity, preferred language, or age.
- To a life free from violence
- To healthy intimate relationships based on equality and respect
- To physical, sexual, and emotional safety
- To exercise control over her economic situation
- To make decisions that are in her best interest and the best interests of her children
- To ask for help if her rights are violated
If You Have Been Sexually Assaulted
You have the following rights under Iowa law:
- To receive written notification of your rights, in English and Spanish, from law enforcement
- To
request the presence of a victim counselor at any proceeding related to
the offense including medical exams, law enforcement investigations,
and cour hearings
- To have a sexual abuse examination performed at the state^s expense
- To
request that an officer assist you in obtaining transportation to the
nearest hospital or otherwise assist you if you are in need of medical
treatment
- To file a complaint for threats, assaults, or other related crimes
- To receive information from law enforcement about how you can register as a victim with the county attorney in your area
- To contact the county attorney or local law enforcement to determine the status of your case
- To apply for victim compensation
If You are a Victim of Domestic Violence:
You have the following rights under Iowa law:
- To receive written notification of your rights, in English and Spanish, from law enforcement
- To
request the presence of a victim counselor at any proceeding related to
the offense including medical exams, law enforcement investigations,
and cour hearings
- To
request that an officer assist you in obtaining transportation to the
nearest hospital or otherwise assist you if you are in need of medical
treatment
- To request that
an officer remain at the scene until you and other affected parties can
leave or until safety is otherwise ensured
- To file criminal charges for threats, assualts or other related crimes
- To seek
temporary and/or permanent assistance from the court in keeping your
attacker away from you, your home, and your place of work
- To seek
temporary and/or permanent assistance from the court in getting custody
of your children and obtaining support for yourself and your minor
children if your attacker is legally required to provide support
- To stay at your home without intereference from your attacker
- To apply for victim compensation
Additionally,
if you are a victim of domestic violence and/or sexual assault and you
do not have citizenship or legal permanent residency in the United
States, you may qualify to petition for your residency/citizenship
under the provisions of the Violence Against Women Act or the U
