Real Estate Agent/Broker/Lender/Lawyer

Address

To _______________,

I am a tenant at _______ in Oakland, California.  This property has gone into foreclosure and I am being asked to vacate the property by you, the authorized agent of the new owner.  I received the ___ day notice to vacate on ____, 2008.

I have been speaking with a local fair housing agency, Sentinel Fair Housing, and have been advised of my rights.

The City of Oakland, California’s Just Cause Ordinance (Measure EE) protects some Oakland renters from no cause evictions. Measure EE states that renter’s living in units built before 1980 that are not owner occupied can only be evicted for ten just reasons and foreclosure is not one of them. Under Measure EE, the notice to vacate that I was sent does not comply with local law.

I have no plans to move-out in the foreseeable future. Please advise me as to where I should send rental payments and to whom I should direct repair requests in the future.

Please contact me if you have any questions. Thank you for your time.

Sincerely,
